PRIVACY POLICY

At ESET we respect and value your privacy. We believe in technology – and we want to make sure that you can enjoy it in safety. The purpose of this Privacy Policy is to provide you information about how we may collect, use, or disclose your Personal Information. By using ESET’s Site, you expressly accept and consent that your information may be transferred across international borders to server locations supporting the Site (including but not limited to transfers from those locations back to the country of your registration) for operating and developing the Site. Non-Personal Information Automatically Collected
ESET is committed to the protection of privacy of the Site’ visitors. Non-personal information is information automatically collected about your use of ESET services that does not identify you in any way. Please note that ESET may provide aggregate statistics about our customers, sales, traffic patterns, and related Site information to trusted third parties, but these statistics will not include any personally identifying information.

Personal Information is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. ESET collects Personal Information for the purposes of provision, development, and personalization of the Site, services and/or products, research and demographics, statistics, and customer care. Specifically, ESET collects Personal Information for the purposes of personal communication with you in order to respond to your questions and fulfill your requests.

Such information includes your name, mailing address, e-mail address, and telephone number. We may also collect your payment information and commercial information, like your purchase history when you make purchase with us. In addition, to provide you with customer service related to our products and services, we may collect instant chat information and we may record customer service phone calls.

This information may be used to contact you for direct marketing purposes via mail, e-mail, or phone to conduct market research, and to inform you of and get your feedback on upcoming products, services, and/or promotions. If you send us product orders, service requirements, or if you send any material to the Site, we might have to contact you in order to gain additional information necessary for processing or fulfillment of your orders and/or requirements.

Accuracy of Collected Data 
ESET will on its own initiative, or at your request, replenish, rectify, or erase any in-complete, inaccurate, or outdated Personal Information retained by ESET in connection with the operation of the Site.

Sharing Data with Third-Party Partners and Customers
ESET may share your Personal Information with third party businesses in order to process your order, fulfill your requests, understand how you interact with our website, in order to provide you with a better experience, determine your interest in our products, improve the quality of our offerings, support our marketing efforts and enable us to send you meaningful ads, serve our advertisements on third-party platforms to audiences and individuals interested in our products and services, and as otherwise described in our Cookies Policy. 3. How We Use Automatic Data Collection Tools

Internet or Network Activity
ESET may use automatic data collection tools to collect your internet or network activity, including your IP address, cookie data, type of operational system in your computer, internet browser type, and addresses of connected sites, in order to improve provided services.

4. Children’s Privacy

Our Site is intended for users who are 13 years or older. We do not knowingly collect information from children under 13 years old. If you are a parent or legal guardian and think your child under 13 has given us information, you can call us at (619) 876-5424 or email us at privacy@eset.com.

If we learn that we have collected the information of a child under 13, we will delete such information from our records.

5. Changes to Our Privacy Statement

Modification of the Privacy Policy 
This Policy is reviewed and updated at least annually to ensure it accurately captures our practices and procedures. The effective date of each version of this Policy is identified below. If we make material changes to this Policy, we will use reasonable means to inform you and, where necessary, obtain your consent.

8. ESET LLC EU-US Privacy Shield Compliance

ESET complies with the EU-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of Personal Information from European Union member countries. ESET has certified that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access and Recourse, Enforcement, and Liability. If there is any conflict between the policies in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with EU-US Privacy Shield Principles, ESET commits to resolve complaints about your privacy and our collection or use of your Personal Information. European Union individuals with inquiries or complaints regarding this Privacy Policy should first contact ESET at: privacy@eset.com.

ESET has further committed to refer unresolved privacy complaints under the EU-US Privacy Shield Principles to JAMS US-EU PRIVACY SHIELD, an alternative dispute resolution provider located in the United States. To file a complaint with JAMS click here.
If your complaint is not resolved through the above channels, under limited circumstances you may be able to invoke binding arbitration before a Privacy Shield Panel.

Such as debit and credit card number.

This data is collected from you when you purchase our products or services.

For all requests submitted via email, please clearly state that the request is related to “Your California Privacy Rights” and provide your name, mailing address, and phone number where you may be reached.

Verification. Before we can respond to your request, we must first verify your identity using your Personal Information. If we are unable to verify your request, we will contact you for more information. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.

Designating an Authorized Agent. You may designate someone to submit requests and act on your behalf (an “Authorized Agent”). To do so, you must provide us with written permission to allow your Authorized Agent to act on your behalf.

Third-party Marketing and Selling. We do not provide your information to third parties for their direct marketing purposes. We also do not sell or intend to sell your Personal Information to third parties.

Do Not Track. We may collect information about your usage and activity through cookies. Some web browsers or smartphones have the ability to set “Do Not Track” requests to block user activity from being tracked across web pages or devices. Our site does not recognize “Do Not Track” browser signals.

We Will Not Discriminate Against You. We will not unlawfully discriminate against you for exercising any of these rights.

Changes to This Notice. We will continue to review and revise our privacy practices and policies as our technology, services, and use of data evolves. We will not retroactively use or share data in a manner that is materially different from this policy without first providing you notice.
