ROGERS CUP TECH & TENNIS GIVEAWAY
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
1. General:
The “Rogers Cup Tech & Tennis Giveaway” (the “Contest”) is offered by ESET Canada Inc., 181 Bay Street, Suite 3620, Toronto, ON M5J 2T3 (“ESET” or “Contest Sponsor”). The Contest is in no way sponsored, endorsed or administered by LinkedIn or any other social websites (“Social Platforms”).
2. Eligibility:
The Contest is open to all legal residents of Canada, excluding the province of Quebec, who are of the age of majority or older in their province/territory of residence. Notwithstanding the above, the Contest is not open to employees, officers and directors of the Contest Sponsor, its respective divisions, subsidiaries, affiliates, advertising and promotional agencies and agents, contest suppliers, prize suppliers, members of their immediate families (parents, siblings, spouses) and those with whom they are domiciled.
3. Agreement to Rules:
By participating, each participant (“You”) agree to be fully and unconditionally bound by these Official Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decision of ESET as final and binding as it relates to the Contest.
4. Contest Period:
Entries will be accepted online from July 1, 2017 at 12:01:00 a.m. Eastern Time (“ET”) through July 31, 2017 at 11:59:59 p.m. ET (“Contest Period”).
5. How to Enter:
To enter, You must submit an entry using the online form (www.eset.com/ca/RogersCupTechDay). Any other form of entry is void. The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to these Official Rules may be disqualified at the sole discretion of ESET. You may enter only once. You must provide the information required. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these Official Rules. If you use fraudulent methods or otherwise attempt to circumvent these Official Rules, your submission may be disqualified at the sole discretion of ESET. All entries must be received and recorded during the Contest Period to be eligible for the drawing.
In the event of a dispute concerning who submitted the entry, the entry will be deemed to have been submitted by the authorized holder of the email account from which the entry is submitted assigned by an internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address. The potential winner may be required to provide identification sufficient to show that he/she was the authorized account holder.
6. Prizes:
Five (5) “Tech & Tennis Prizes” are available to be won. Each Tech & Tennis Prize consists of one (1) pair of tickets to the Tech & Tennis Day at Rogers Cup in Toronto, including attendance to the technology presentations starting at 8:30 a.m. ET on August 10, 2017 and tickets to the ESET VIP Suite, Round of 16, Session 9, on August 10, 2017, along with one (1) VIP parking pass. The approximate retail value of each Tech & Tennis Prize is $290.
The specifics of each Tech & Tennis Prize shall be solely determined by ESET. No cash or other prize substitution shall be permitted except at ESET’s discretion. A Tech & Tennis Prize is nontransferable and nonassignable. Any and all prize-related expenses, including, without limitation, any and all federal, provincial, and/or local taxes, shall be the sole responsibility of the winner. Acceptance of a Tech & Tennis Prize constitutes permission for ESET to use a winner’s name, likeness, and entry for purposes of advertising and trade without further compensation or approval,
The Tech & Tennis Prize does not include and ESET is not responsible for travel to or from the venue. Any Tech & Tennis Prize details not specified herein will be determined by the ESET at its sole discretion.
7. Odds:
The odds of winning depend on the number of eligible entries received during the Contest Period.
8. Winner Selection and Notification:
Winners will be selected by random drawing from all eligible entries received. The drawing will be conducted under the supervision of ESET on or about August 1, 2017. Potential winners will be notified by email. ESET shall have no liability for a potential winner’s failure to receive a prize notification due to spam, junk email or other security settings or for a potential winner’s provision of incorrect or otherwise non-functioning contact information. If Contest Sponsor is blocked from contacting a potential winner via email, or the potential winner is found to be ineligible, does not or cannot comply with these Official Rules, the prize notification is returned as undeliverable or a potential winner cannot be reached via email within two (2) days from the time a prize notification was sent that potential winner will be disqualified and an alternate potential winner will be selected from remaining eligible entries.
As a condition of receiving a Tech & Tennis Prize, the potential winner will be required to correctly answer a mathematical skill testing question and may be required to complete, sign and return to Contest Sponsor an affidavit of eligibility and liability release and, a publicity release within the time period designated by Contest Sponsor, if Contest Sponsor so requests, in Contest Sponsor’s sole discretion. If a potential winner fails to do so, or is found to be ineligible, each in Contest Sponsor’s sole discretion, that potential winner may be disqualified. Tech & Tennis Prizes will be distributed via priority mail no later than August 8, 2017.
No entrant is a winner of a Tech & Tennis Prize unless and until that entrant’s eligibility has been verified and Contest Sponsor has confirmed the verification to the winner, even if that entrant’s name has been publicly posted as a winner prior to completion of the verification process.
Receipt by winner of a Tech & Tennis Prize is conditioned upon compliance with any and all applicable federal, provincial, municipal and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY A POTENTIAL WINNER (AT ESET’S SOLE DISCRETION) WILL RESULT IN THE POTENTIAL WINNER’S DISQUALIFICATION AS A POTENTIAL WINNER OF THE CONTEST, AND ALL PRIVILEGES AS A POTENTIAL WINNER WILL BE IMMEDIATELY TERMINATED.
9. Rights Granted by You:
By participating in the Contest, You agree to abide by and be bound by these Official Rules, and to waive any right to claim any ambiguity or error herein or in the Contest itself, and to be bound by all actions of Contest Sponsor and/or Contest Sponsor's representative. Contest Sponsor, anyone acting on its behalf and its licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. You agree to waive any moral rights for this purpose.
10. Waiver:
By entering the Contest, You understand and agree that any submission may be refused as an entry to the Contest as may be determined by ESET in its absolute discretion. You agree to abide by these Official Rules and the decisions of ESET with respect to all aspects of the Contest, which are final. To the extent permitted by law, ESET accepts no responsibility for loss, damage or claims caused by or resulting from the Contest and/or the Tech & Tennis Prizes. Without limiting the foregoing, ESET will not be responsible for late, lost, illegible, falsified, incomplete or destroyed entries and all such forms are void. The Contest is subject to all applicable federal, provincial, municipal and local laws and regulations. ESET reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should a virus, bug, non-authorized human intervention, fraud, or other cause beyond ESET’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, ESET may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by ESET. ESET reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Official Rules. ESET has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, ESET reserves the right to seek damages to the fullest extent permitted by law.
11. Limitations of Liability and Release:
By entering the Contest, You agree for yourself and for Your heirs, executors, and administrators, to release, indemnify, defend and hold harmless (a) the Contest Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, partners and prize suppliers (collectively, “Contest Entities”) and their respective representatives, agents, successors, assigns, employees, officers, and directors and the Social Platforms from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Contest and/or Your acceptance, possession, use, or misuse of a Tech & Tennis Prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Contest or the processing of entries.
12. Disputes and Jurisdiction:
THIS CONTEST IS GOVERNED BY THE LAWS OF THE PROVINCE OF ONTARIO AND THE FEDERAL LAWS OF CANADA APPLICABLE IN ONTARIO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES.
As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Toronto, Ontario having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.
13. Privacy Policy:
