OFFICIAL RULES - TERMS & CONDITIONS
NO PURCHASE IS NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW.
1. Eligibility:
This Sweepstakes is offered by ESET, LLC dba ESET NORTH AMERICA (ESET) and is open to all legal residents of the 50 United States who are 18 years of age or older (“You”). Employees of ESET and/or its affiliated companies and family members of such employees may not enter to win the Sweepstakes giveaway. ESET reserves the right to stop the promotion or cancel the Sweepstakes without notice and at any time. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
2. Agreement to Rules:
By participating, the You agree to be fully unconditionally bound by these Rules, and You represent and warrant that you meet the eligibility requirements. In addition, You agree to accept the decision of ESET as final and binding as it relates to the content of this Sweepstakes.
3. Campaign Period:
Entries will be accepted online from October 4, 2021, 12:00 a.m. PST through October 31st, 2021, 11:59 p.m. PST.
4. How to Enter:
Participants may enter the sweepstakes by entering the required information in the provided contest form on ESET.com from September 30, 2021, 12:00 a.m. PST through October 31st, 2021, 11:59 p.m. PST. Additional actions as described on contest form will increase entries for the sweepstakes. Winner must meet the eligibility requirements stated above and as set forth herein in order to qualify for the prize.
Participants may submit additional entries by visiting ESET’s Facebook, Instagram, and Twitter profiles, along with subscribing to Data Security Guide, SaferKidsOnline, and ESET’s YouTube profile. Additional entries can be submitted by watching the provided video on contest form.
In the event of a dispute concerning who submitted the entry, the entry will be deemed to have been submitted by the authorized holder of the email account from which the entry is assigned by an internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address.
IMPORTANT: ESET is not liable for any disputes between collaborators related to a Submission.
5. Prize:
The Winner of the Sweepstakes (the “Winner”) will be notified via email (“notification”) that they are eligible to receive a One Thousand dollars ($1,000 USD) Airbnb® gift card (“prize’). The Airbnb® gift card is subject to the terms and conditions found www.airbnb.com/help/article/981/airbnb-gift-cards ..The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for ESET to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
6. Odds:
Based upon the estimated number of entries, the odds of winning are approximately one (1) in Fifty (50). The actual odds of winning will depend on the number of eligible entries received for this sweepstakes.
7. Winner Selection and Notification:
There will be one (1) Winner selected by automated random draw of participant entries under the supervision of ESET. The Winner will be notified via the provided email address within five (5) business days of November 1, 2021 (“award notification date”), and to receive the prize the Winner MUST REPLY to the notification with their mailing address within five (5) business of days of the award notification date. Once Winner has replied and provided their mailing address, the prize will be delivered via email within ten (10) business days. ESET shall have no liability for the Winner’s failure to receive notices due to spam, junk email, or other security settings or for Winners’ provision of incorrect or otherwise non-functioning contact information. If Winner fails to claim the prize within five (5) business days from the award notification date, the prize may be forfeited and an alternate Winner selected. Delivery of the prize as offered to the Winner for this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT ESET’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. Rights Granted by You:
By entering this Sweepstakes, You understand and agree that ESET, anyone acting on behalf of ESET and ESET’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
9. Terms & Conditions:
ESET reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or any other cause beyond ESET’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, ESET may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by ESET. ESET reserves the right, in its sole discretion, to disqualify any Participant who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules -Terms & Conditions. ESET has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same email in excess of the number allowed by Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, ESET reserves the right to seek damages to the fullest extent permitted by law.
10. Limitations of Liability and Release:
By entering, You agree to release and hold harmless ESET and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
11. Disputes and Jurisdiction:
THIS Sweepstakes IS GOVERNED BY THE LAWS OF United States of America. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in San Diego County, California having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes). Participant further waives all rights to have damages multiplied or increased.
