Terms and Conditions


Please review these Official Rules before entering the contest. No purchase is necessary to enter or win. Purchasing our product will not increase your chances of winning. All federal, state, and local laws apply. Void where prohibited.
 
1. Eligibility:
Nonprofit Pitch Fest: What’s in Your Future? (“Pitch Fest”) is open to all registered 501(c)(3) organizations and doing business in the United States of America. Employees of ESET and other companies associated with the promotion of Pitch Fest, and their respective parents, subsidiaries, affiliates, and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of such employee are not eligible. Pitch Fest is subject to federal, state, and local laws. A minor in the jurisdiction in which they reside must get their parent's or legal guardian's permission prior to entering.

2. Sponsor:
Pitch Fest is sponsored by ESET North America, located at 610 W Ash St #1700, San Diego, CA 92101. 

3. Agreement to Official Rules:
Participation in Pitch Fest constitutes entrant’s full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. 

4. Contest Period:
The Contest begins on July 14, 2017 and ends on September 15, 2017. Submissions for participation must be received by ESET no later than August 15, 2017 to be eligible to move onto the next phase of the contest for public voting. Essays that are submitted after August 15, 2017 will be not be considered. 

5. How to Enter:
To participate, follow the instructions on the Entry Form and submit online at https://www.eset.com/us/pitchfest/. Limit 1 entry per organization for the duration of Pitch Fest, regardless of method of entry. Entries received from any organization in excess of the stated limit will be void. All entries become the property of Sponsor and will not be acknowledged or returned. All entrants must complete an Entry Form and answer the Essay Question listed on the Entry Form. The person submitting the Entry Form must be an authorized representative of the nonprofit organization and will be deemed the entrant. The Entrant is the one person who owns the email address associated with the Submission.

6. Public Voting:
Between August 16 – Sept. 15, members of the public will have the opportunity to vote for an organization to win the prize money. Members of the public can only vote once, and for one nonprofit. If at any time it appears as though the public vote has been manipulated, ESET has the right to disqualify entrants from the contest. 

7. Prize Selection:
On or about October 16, 2017 the results from the public voting and winners will be announced. One first prize winner, and five runners up will be announced. The top 10 vote getters (based on the Public Vote) will move to the final round, where the ESET Selection Committee will chose one grand prize winner (to receive $20,000), and five runner ups (receiving $2,000 each). 

8. Winner Notification:
The winners will be notified by email, mail and phone. All winning organizations will be required to complete, electronically sign and submit an Affidavit of Eligibility and (where imposing such condition is legal) Publicity Release forms within 5 business days of the date notice or attempted notice is sent, in order to claim their prize. If a winner cannot be contacted, or fails to submit the Affidavit of Eligibility and (where legal) Publicity Release forms within the required time period, the winner forfeits the prize. All winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner, as selected by Sponsor. Prizes will be fulfilled approximated 3 months after the conclusion of Pitch Fest, and awarded no later than January, 2018. 

9. Prizes:
The first place winner will be awarded $20,000, and five runners up will be awarded $2,000 each. No more than the advertised number of prizes will be awarded. All taxes relative to the prize are the sole responsibility of the winner. 

10. General Conditions:

  1. In the event that the operation, security, or administration of Pitch Fest is impaired in any way for any reason, including but not limited to fraud, cyber-attack, unauthorized human intervention, or other technical problem, or in the event Pitch Fest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend Pitch Fest to address the impairment and then resume Pitch Fest in a manner that best conforms to the spirit of these Official Rules or (b) terminate Pitch Fest and, in the event of termination, award the prize at the Sponsor’s discretion to eligible, qualified, non-suspect entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of Pitch Fest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages (including attorneys’ fees) and any other remedies from any such person to the fullest extent permitted by law.
  2. Failure by the Sponsor to enforce any provisions of these Official Rules shall not constitute a waiver of that provision. By participating, entrants acknowledge and agree that they have entered Pitch Fest of their own free will, that the Official Rules have been made available to them in writing.
  3. By submitting an Entry, each Entrant agrees Sponsor shall unconditionally and irrevocably own the Entry submitted including all rights embodied therein in winning entries and that Sponsor and its designees may use, publish, adapt, modify, combine, or dispose of any Entry, online, in print, film, television, or any other media now or hereafter without additional compensation or notification to, or permission from, the Entrant, except as prohibited by law.
  4. Any false information provided within the context of the contest by any Entrant concerning 501(c)(3) designation, identity, email address, telephone number, or non-compliance with these Official Rules, or the like, may result in the immediate elimination of the organization from Pitch Fest. The Sponsor further reserves the right to disqualify any entry that it believes in its sole and unfettered discretion infringes upon or violates the rights of any third party, otherwise does not comply with these Official Rules, or violates U.S. or applicable state or local law.
  5. By submitting an entry, entrants thereby represent and warrant that the submitted work or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and the entrants affirm they have the right to grant any and all rights and licenses granted to the Sponsor herein, including but not limited to, all necessary rights under copyright, free and clear of any claims or encumbrances.


11. Release and Limitations of Liability:
By participating in Pitch Fest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with Pitch Fest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in Pitch Fest or receipt or sue of the prize, including but not limited to (a) any technical errors associated with Pitch Fes, including lost, interrupted, or unavailable Internet Service Provider, network, server, wireless service provider, or other connections; (b) unauthorized human intervention in Pitch Fest; (c) mechanical, network ,electronic, computer, printing, human, or typographical errors; or (d) any other errors or problems in connection with Pitch Fest, including without limitation, errors that may occur in the administration of Pitch Fest, the announcement of the winner, the cancellation or postponement of the event. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of participating in Pitch Fest. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in Pitch fest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

12. Disputes and Jurisdiction:

  1. Any controversy or claim arising out of or relating to Pitch Fest shall be settled by arbitration administered by the American Arbitration Association. The number of arbitrators shall be three. The place of arbitration shall be San Diego, California. California state law shall apply. Judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.
  2. Each party shall pay its own proportionate share of arbitrator fees and expenses (plus the fees and expenses of the arbitrator it designated) and the arbitration fees and expenses of the American Arbitration Association. The arbitrators shall be entitled to award the foregoing arbitration and administrative fees and expenses as damages in their discretion.
  3. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with Pitch Fest, shall be governed by the laws of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than California.


13. Privacy:
Information collected from entrants is subject to Sponsor’s PRIVACY POLICY. By entering this contest, participants consent to the use of their name, likeness, image and biographical data for advertising and promotional purpose without additional compensation, except where prohibited by law.

14. Contest Inquiries:
You can obtain a list of the official winners (after the conclusion of Pitch Fest) by sending a stamped, self-addressed envelope to 610 West Ash St. #1700, San Diego, CA 92101. Please make sure to put ESET - ATTN: PR as the recipient. Please be certain to specify that you are requesting the “Official Winner List” for Pitch Fest .
