CALIFORNIA PRIVACY RIGHTS

EFFECTIVE DATE: October 2, 2025

This California Privacy Rights Notice supplements the general Privacy Policy and provides additional information for California residents pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”). This section applies to “Personal Information” as defined in the CCPA, whether collected online or offline. This section does not address or apply to our handling of Personal Information that is exempt under the CCPA such as publicly available information or deidentified or aggregated information. To the extent you are a resident of California, and we collect Personal Information subject to CCPA, the following applies.


Personal Information We Collect & Sources

Our collection, use, and disclosure of your Personal Information varies depending upon our interactions or relationship with you. For more information about what we collect and our information practices, please review ESET’s general Privacy Policy.

In addition to individual consumers who visit our Site and use our Services, ESET also collects Personal Information from representatives of our business customers and enterprise customers as part of business-to-business transactions. This means that we collect Personal Information from employees, owners, directors, officers, and contractors of our business and enterprise (“B2B”) customers. Additionally, ESET collects Personal Information from representatives of its resellers and distributors (“Partners”).

We generally collect Personal Information from the following sources:

  • Directly or indirectly from you;
  • Our affiliates and subsidiaries;
  • Our business partners;
  • Operating systems and platforms; and
  • Publicly available information and sources.

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the business purposes set forth in ESET’s Privacy Policy.

ESET will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.


Sharing Personal Information with Third Parties and Other Recipients

We may have shared your Personal Information with the following third parties and other recipients in the past 12 months:

  • Affiliates and business partners;
  • Service providers;
  • Marketing and analytics providers;
  • Regulatory and government entities, including law enforcement; and
  • Other parties with your consent.

Additionally, CCPA defines a "sale" as disclosing or making available Personal Information to a third party in exchange for money or other valuable consideration. CCPA also defines “sharing” to include disclosing or making available Personal Information to a third party for purposes of cross-context behavioral advertising. While we do not disclose Personal Information to third parties in exchange for money, we may “share” (as defined by the CCPA) personal identifiers and internet and electronic network activity information to third-party ad networks and analytics providers. We share this information to improve and evaluate our advertising campaigns and better reach customers and prospective customers with more relevant ads and content. We do not sell or share sensitive Personal Information, nor do we sell or share any Personal Information about individuals who we know are under sixteen (16) years old.


California Privacy Rights

To the extent you are a resident of California, you may have the following rights to your Personal Information:

  • Right to Know/Access: With respect to the Personal Information we have collected about you in the last 12 months, you have the right to request from us (up to twice per year and subject to certain exemptions): (i) categories of Personal Information about you we have collected; (ii) the sources from which we have collected that Personal Information; (iii) our business or commercial purposes for collecting, selling, or disclosing that Personal Information; (iv) the categories of third parties to whom we have disclosed that Personal Information; and (v) a copy of the specific pieces of your Personal Information we have collected.
  • Right to Correct: You have the right to request that we correct inaccuracies in your Personal Information.
  • Right to Delete: Subject to certain conditions and exceptions, you may have the right to request deletion of Personal Information that we have collected about you.
  • Right to Opt-Out of Sale/Sharing: You may have the right to opt-out of the “sale” or “sharing” of your Personal Information.  To opt out from the sharing or sale of information described above, please click on the “Do Not Sell or Share My Personal Information” link on the bottom of this webpage. If our Site detects that your browser or device is transmitting an opt-out preference signal, such as the “global privacy control” signal, we will opt that browser or device out of cookies on our Site that result in a “sale” or “sharing” of your Personal Information. If you come to our Site from a different device or from a different browser on the same device, you will need to opt-out, or use an opt-out preference signal, for that browser and/or device as well.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of the rights described in this section.
  • Authorized Agent: You may designate someone as an authorized agent to submit requests and act on your behalf. To do so, you must provide us with written permission to allow the authorized agent to act on your behalf.

Submitting Privacy Requests

Please indicate you are making a request pursuant to your “California Privacy Rights.” You must provide us with the following information: (1) first and last name; (2) email address.

We will process your request based upon the personal information in our records that is linked or reasonably linkable to the information provided in your request. In some cases, we may request additional information to verify your request or, where necessary, to process your request. If we are unable to adequately verify a request, we will notify the requestor. You may also use an Authorized agent to submit a request on your behalf. The Authorized agent may initiate a request by contacting us at ccpa@eset.com. Authorized agents will be required to provide proof of their authorization, and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.


Financial Incentive Program

From time to time, ESET may offer programs (“Programs”) which may be considered financial incentives provided in exchange for the collection and retention of your personal information (“data”) under California law. While we do not assign a monetary value to the data that we collect, based on our good faith estimate, the value received from the Program is reasonably equal to or greater than the value ESET receives from any data. ESET may also use the data to improve products, services and customer experiences. These financial incentives include discounts, coupons, gift cards, survey rewards, and financial incentives of various forms of payment. Participation in any Program is voluntary. You can participate in any current Program, or  revoke your consent to participate, by emailing us at info@rewards.eset.com.


Changes to This Notice

The Notice is current as of the Effective Date set forth above.  We will continue to review and revise our privacy practices and policies as our technology, services, and use of data evolves, so please be sure to check back periodically. We will post any updates to this Policy here. If we make any changes to this Policy that materially affect our practices regarding our use of the Personal Information we have previously collected from you, we will endeavor to provide you with notice.
